Welcome to Figgle. These Terms of Service ("Terms") govern your access to and use of Figgle's website, services, and applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

These Terms constitute a legally binding agreement between you and Figgle. If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Figgle provides a platform for accessing, browsing, and downloading Figma designs. Our Service includes:

• A library of free and premium Figma designs
• Design search and discovery features
• Bookmarking and organization of designs via collections
• Download access to Figma designs

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that harm the Service or other users.

4. Subscription Plans and Billing

4.1 Subscription Tiers

Figgle offers the following subscription tiers:

• Free: Access to free designs only
• Pro: Unlimited access to all free and premium designs

4.2 Billing

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan). You authorize us to charge your payment method for the subscription fee at the start of each billing period.

• All fees are in U.S. dollars unless otherwise stated
• Subscription fees are non-refundable except as required by law
• Prices may change with 30 days' notice
• Failed payments may result in suspension of your subscription

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting support. Cancellations take effect at the end of your current billing period.

No Refunds: We do not provide refunds for partial billing periods. If you cancel, you will retain access to paid features until the end of your current billing period.

4.4 Subscription Management

You may manage or cancel your paid subscription at any time from the Plans page in your account.

5. Intellectual Property Rights

5.1 Figgle's Rights

The Service, including all content, features, and functionality, is owned by Figgle and is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the Service or its underlying code
• Reverse engineer or attempt to extract the source code
• Remove or alter any copyright, trademark, or proprietary notices
• Use the Figgle name or branding without permission

5.2 Design License

When you download a design from Figgle, you receive a license to use that design in your design projects, subject to the following restrictions:

• Designs may be used in commercial and personal projects
• You may not resell, redistribute, or sublicense designs as standalone files
• You may not claim authorship of the original design
• You may not use the design for any illegal or unauthorized purpose
• You may not use the design to create competitive products or services
• Attribution is appreciated but not required unless specified

5.3 User-Uploaded Content

If you upload designs to Figgle (as an authorized admin user), you retain ownership of your content but grant Figgle a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content through the Service.

You represent and warrant that you have all necessary rights to grant this license and that your content does not infringe on any third-party rights.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or its servers
• Use automated tools (bots, scrapers) to access the Service without permission
• Circumvent any access restrictions or payment requirements
• Share your account credentials with others
• Use the Service for any illegal or unauthorized purpose

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Components will meet your specific requirements
• Any errors or defects will be corrected
• The Service will be available at all times

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIGGLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO FIGGLE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Figgle and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload to the Service

10. Dispute Resolution

10.1 Informal Resolution

If you have a dispute with Figgle, please contact us first at legal@figgle.app to attempt to resolve it informally.

10.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [JURISDICTION], without regard to its conflict of law provisions.
